General Terms and Conditions for using the analysis platform of proclk.com. Please read these terms carefully.
These Terms of Use govern the legal framework for using our online platform for the analysis of user behavior and interactions on the internet.
The contractual partner is proclk.com, represented by the management, with its registered office at Kleinplatz 26. By registering and using our services, you accept these terms.
We provide a Software-as-a-Service platform for analyzing online interactions and user behavior on digital platforms. The specific feature sets of the booked packages are detailed in the respective service description on services.html.
The platform provides tools for the collection, aggregation, and visual preparation of data. The quality of the results depends on correct integration and the provided data sources.
The user undertakes to use the services only within the framework of applicable laws, in particular data protection law (GDPR, BDSG).
The use of the platform is intended solely for the user's own business or private use. Sharing login credentials or commercially reselling the service is not permitted.
The user guarantees that all data they feed into the platform is free from third-party rights and that they are authorized to process it.
Our liability is limited, to the extent permitted by law, to intent and gross negligence. For ordinary negligence, we are liable only in the event of a breach of essential contractual obligations (cardinal duties) and limited to the typically foreseeable damage.
Liability for indirect damages, lost profits, or data loss is excluded, unless mandatory law provides otherwise. The platform is provided "as-is". We do not guarantee constant availability or freedom from errors.
Contracts with a monthly term can be terminated by either party with a notice period of 14 days to the end of the month. Annual contracts run for 12 months and are automatically renewed for another year if not terminated with a notice period of 3 months to the contract end date.
The right to terminate without notice for good cause remains unaffected. Good cause exists in particular in the event of material breaches of contract, payment delays of more than 30 days, or illegal use of the platform.
Changes to these Terms of Use will be communicated to you via email to the address on file. They are considered approved if you do not object within 4 weeks of receiving the notification. Your right to object will be pointed out in the notification.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes, to the extent legally permissible, is our registered office at Kleinplatz 26.
